Agreement signed by Confindustria, confederal unions, INL and INPS

On 19 September 2019, an agreement was signed on the measurement of trade union representation in private labour relations. The signatories are CGIL, CISL, UIL, Confindustria, the National Labour Inspectorate and INPS. This latter institute will measure the representative weight of each union by the average number of members and the votes obtained in the RSU elections.

Only the trade union organisations with a percentage of representativeness (given by the mix between members and votes) equal to 5% (as in the public sector) can be qualified as "comparatively more representative trade union associations at national level" and therefore be considered as valid interlocutors for the stipulation of agreements that may derogate from certain legal provisions. Only the contracts signed by trade unions who represent at least 50% of the workers concerned will consequently be able to set up bilateral bodies (meaning in which also the housing funds are included), sign "proximity contracts" as per art. 8 of the Legislative Decree no. 138/201 and collective agreements suitable for regulating aspects related to the types of contract referred to in art. 51 of Legislative Decree no. 81/2015 (such as the maximum duration and percentage of fixed-term contracts, the regulation of intermittent relations, etc.) and to supplement or derogate from the provisions of Legislative Decree no. 66/2003 concerning working times.
