Legislative Decree 101/2018, which co-ordinates Italian regulations with the GDPR, in force since 19th September
On 19th September, the Legislative Decree no. 101 of 10th August 2018 came into force, which finally co-ordinates Italian privacy regulations with those introduced by GDPR 2016/679, which is the General Data Protection Regulation of the European Union.
Starting from this date, new administrative sanctions were introduced. An adaptation phase of eight months is scheduled for the application of these sanctions, during which the Privacy Guarantor, in punishing future offenders, will take a lenient view - at least so it seems – of the difficulties encountered by citizens and businesses in understanding and applying the new provisions. This follows the repeal of many previous regulations and the need to co-ordinate the surviving articles of the old Privacy Code with the new European Regulation.
These difficulties should be mitigated in the near future, thanks to the guidelines issued by the Guarantor (especially regarding security measures, genetic data, biometric, judicial and health), which will remain the only legal reference points for those responsible for personal data processing after the disappearance of general authorisations and preliminary verifications, again by the European Regulation and the Legislative Decree 101/2018.
