The Cassation considered legitimate the dismissal of the cashier who had used, via her husband, vouchers due to customers.
The Court of Cassation, with sentence 11181/2019, considered legitimate the dismissal of a supermarket cashier who had withheld - and then made her husband spend in the same store - shopping vouchers (for a total of 24 Euros) that should have instead been given to customers.
This employer dismissal had previously been considered illegitimate by the judgment of the Court of Cosenza. It was later upheld on appeal by the Court of Appeal of Catanzaro which, unlike the judge in the first case, pursuant to art. 2729 of the civil code, deemed to exist the presumptive proof of the wilful and prohibited use of shopping vouchers by the cashier.
